Terms & Conditions SP Internet Technologies:

1. Company means: S P Internet Technologies PVT LTD (SPIT). Its successors and assigns and all other entities involved in the provision of the Service and its local service Franchisee.

2. Customer/Subscriber means: Any person as defined under General Clauses Act 1899 who the Company makes the Contract with. It includes a person who is acting on or for behalf of the Customer.

3. This service is governed by the provisions of Indian Telegraph Act, 1885, Indian Wireless Telegraphy Act, 1993, and Telecom Regulatory Authority of India Act, 1997 as modified or replaced from time to time.

4. Fair Usage limit is applicable on all Unlimited Plans.

5. Contention ratio is applicable on broadband plans.

6. Subscriber/Customer Premise Service Equipment (CPE):

• Subscribers may use their own CPEs. However, such CPEs need to be approved by the Company. In case, of such CPEs: i) No rental or security deposit/charges will be applicable. ii) The Company would not be responsible for maintenance of such CPE’s.
• When CPE provided by Company/ Franchisee for provision of services Property in CPE shall always remain vested with the Company/ Franchisee and neither the property nor right to use the CPE is transferred to any person in any manner whatsoever. i) The Subscriber to whom the CPE is delivered shall be responsible for safety of and securing any other Subscriber as defined in the rate plan towards cost of provision of service so proposed to be provided by the Company/ Franchisee. ii) Manufacturing defects - No Charges to Subscriber. iii) Repairs due to damage attributable to Subscriber - The repair/service charges shall be assessed by the Company/ Franchisee and recovered from the Subscriber accordingly, along with applicable taxes, as additional cost of provision of service by the Company.


• 7. In case Subscriber wants to shift to a new location, delivery of connection will be subject to feasibility and shifting charges will be applicable.
  
  8. Account Disconnection/termination will be done on receipt of CPE by the Company/ Franchisee in working condition and settlement of all balance outstanding. Penalty/damages, if applicable, will be deductible from the refund amount, towards breach of terms of service. Please refer terms and conditions for updated information on refund policy on our website. i) Service tax shall be accounted for against the charges stated above. ii) Refund, if applicable, will be processed within 30 working days from the date of cancellation.
  
  9. All plan charges will be charged in advance, all one-time installation charges are non-refundable. And Service tax is extra as applicable.
  
  10. Upload speed will be 25% of applicable download speed or 1Mbps, whichever is lower.
  
  11. Usage includes both upload and download of data.
  
  12. It will be Customers responsibility to inquire about Customer outstanding and in case of non-receipt of bill, Customer has to contact the Company and pay the amount by the due date. Company reserves the right to withdraw/suspend/terminate the Service partially or fully in case of non-payment of invoice by the due date.
  
  13. The Subscriber agrees not to use the Service


• For sending and receiving any objectionable, obscene or unauthorized content.
• For any content, messages or communications infringing copyright, Intellectual property right and international & domestic cyber laws, in any form or inconsistent with the laws of India.
• For hacking or gaining unauthorized access to any computer systems on the internet.
• To run any internet protocol ("IP") forging or port scanning software to deliberately affect remote machines.
• To use the Service for any anti-national activities would be construed as an offence punishable under the Indian Penal Code or other applicable law.
• To transmit any information or written, graphic or photographic material ("Material") (by uploading, posting, email or otherwise) that is unlawful, threatening, abusive, harassing, tortious, defamatory, obscene, pornographic, libelous, invasive of another’s privacy, threatening, menacing, offensive, hateful or racially, ethnically or otherwise objectionable.
• To transmit any Material (by uploading, posting, email or otherwise) in breach of this Agreement including any Materials that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements).
• To transmit any Material (by uploading, posting, email or otherwise) that infringes any patent, trademark, trade secret, copyright or other intellectual property rights of any third party.
• To transmit (by uploading, posting, email or otherwise) any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
• To transmit any Material (by uploading, posting, email or otherwise) that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
• To harm, or threaten to harm, minors in any way.
• To send emails from SPIT Networks to recipient who do not wish to receive the emails.
• To send any emails with forged header information, nor should you attempt to impersonate any other individual or organization.
• To interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service.
• To hack into the Website or any other related computer system, make excessive traffic demands, forward chain letters, surveys, contests, pyramid schemes or otherwise engage in any other behavior that may reasonably be expected to inhibit other users from using and enjoying the Website or any other website or damage or destroy the reputation of SPIT or any third party.
• To resell or advertise to resell the Services without SPIT’s authorization.
• To use the Service to send unsolicited commercial or bulk electronic mail messages to anyone.


• 14. Refund, if applicable, will be processed within 30 working days from the date of cancellation after customer inform, CPE,Routers,ONT,ONU & Etc remove equipment without any damage condition refund will be applicable , incash any damage in equipment refund policy should be not applicable.



• 15. Refund policy condition , Customer Renewal should be minimum 12 months , Customer expiry ( without renewal) with information 45to60s days Cancellation Refund policy condition should be not applicable.
  
  
• 16. Company reserves the right to revise the charges, Price List, Service Packages for the Service from time to time at its discretion.

  Terms & Conditions Payment Gateway :

  DISCLAIMER

  • This Service is being provided in order to facilitate access to our customers to pay your bills online to SP Internet Technologies Pvt Ltd.,(SPIT) through an electronic and automated collection and remittance service (the "Payment Gateway") hosted through our BillDesk (the 'Payment Service Providers'). SPIT makes no representation of any kind, express or implied, as to the operation of the Payment Gateway other than what is specified for this purpose. The User expressly agrees that his/ her use of the aforesaid online payment Service is entirely at his/her/their own risk and responsibility of the User.
  • In order to pay bills through our site, you must provide us with certain personal information such as your name, your bank debit/credit card number and expiration date, your telephone number, your e-mail address and the name. We require this information so that we can process, fulfill and confirm your payment and keep you informed of each transaction's status.
  • We have implemented technology and security features and strict policy guidelines to safeguard the privacy of your personally identifiable information from unauthorized access and improper use or disclosure.

  LIMITATION OF LIABILITY

  1. SPIT is providing this service to you simply as a matter of convenience. SPIT expressly disclaims any claim or liability arising out of the provision of this service. You agree and acknowledge that you shall be solely responsible for your conduct and that SPIT expressly reserves the right to terminate your rights to use the service at any time it deems fit.
  2. SPIT, its affiliates or employees shall in no way be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data or any other intangible losses arising out of or in connection with the access to or usage of the Payment Gateway service.
  3. SPIT assumes no liability whatsoever for any monetary or other damage suffered by you on account of any delay, failure, interruption, or corruption of any data or other information transmitted or any interruption or errors in connection with the use and operation of the Payment Gateway service.
  4. You shall indemnify and hold harmless SPIT and their respective officers, directors and employees, from any claim or demand, or actions. SPIT will not be liable for any failures in the external link or for any fraudulent actions either at the payment gateway and/or at the bank end that could take place during or after the time of you making payment.
  5. You agree, understand and confirm that any personal data including details related to debit card/credit card or Bank accounts submitted by you during the time of making payment is transmitted over the Internet and is susceptible to misuse, theft and/or fraud and that SPIT has no more control over such matters indulging here.
  6. Although all reasonable care has been taken towards guarding against unauthorized use of any information transmitted by you, SPIT does not in any way guarantee that the use of the payment gateway will not result in theft and/or unauthorized use of data over the Internet.

  DEBIT/CREDIT CARD, BANK ACCOUNT DETAILS

  • You may pay bills at SPIT by using a Debit/Credit Card or through your Internet Banking Account. You submit and agree that the debit/credit card details provided by you to the Payment Gateway for payment transaction processing will be correct and you shall not use a debit/credit card, which is not lawfully owned by you. You agree that when you initiate a payment transaction and/or issue an online payment Instruction and provide your Debit/Credit Card or Bank account details:
    • You warrant that you are fully and lawfully entitled to pay your internet bill with their Debit/Credit Card or Bank Account details for such online transactions.
    • You are responsible to ensure that all the Debit/Credit Card or Bank Account details provided by you are accurate and you are authorising the debit to the nominated Debit/Credit Card or Bank account for the settlement of bills selected by you.

    • You are responsible to ensure that sufficient credit is available on your presented Debit/Credit Card or Bank Account at the time of making the payment to permit the payment of the bill/s selected by you inclusive of the applicable fees.
  • Convenience fees shall be levied for Online Payments using any payment channel (Credit Card/Debit Card/Net Banking). Convenience fee can also be referred to as Internet handling fee. Convenience fee can be either a flat fee (Net Banking) or a percentage (Card Gateway) of the amount that you pay depending on the payment mode selected.

  Refund & Cancellation Policy
